High Court to Determine Validity of ACT Marriage Laws

The Sydney Morning Herald has reported that the Commonwealth Attorney General has filed documents in the High Court challenging the validity of the marriage laws passed by the ACT government.

It is expected that the hearing will take place in the near future.

Adult Child Support

An interesting recent court Case
CHILD MAINTENANCE - FOR CHILDREN OVER 18 YEARS - A LITTLE KNOWN PROVISION IN THE FAMILY LAW ACT

Section 66L of the Family Law Act allows the Family Courts (Family Court and the Federal Circuit Court) to make orders providing for the financial maintenance of children over the age of 18 years provided that the Court is satisfied that maintenance beyond 18 years is necessary by reason of: to enable a child to complete his or her education or because of mental or physical disability of a child.

A recent case in the Federal Circuit Court at Brisbane resulted in a parent of an adult disabled child of a relationship being ordered to pay all of the expenses of the carer parent in circumstances where the father had the financial capacity to meet the child's needs.  You can read the case here
